By downloading, installing, or using PulseMap ("the App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App. These Terms constitute a legally binding agreement between you and PulseMap, headquartered in Charlotte, North Carolina, USA.
2. Description of Service
PulseMap provides real-time crowd intelligence for public places including airports, gyms, restaurants, malls, and other venues. Crowd data is sourced from Google Popular Times data and voluntary user-submitted reports. We do not guarantee the accuracy, completeness, or timeliness of any crowd information displayed.
3. Eligibility
You must be at least 13 years of age to use PulseMap.
If you are under 18, you must have permission from a parent or legal guardian.
By using the App, you represent that you meet these requirements.
4. Account Registration
Creating an account is optional. You may browse crowd levels as a guest.
You are responsible for maintaining the confidentiality of your account credentials.
You agree to provide accurate information when creating an account.
You may not create accounts for others without their explicit permission.
We reserve the right to terminate accounts that violate these Terms.
5. Acceptable Use
You agree NOT to:
Submit false, misleading, or fabricated crowd reports
Use the App for any unlawful purpose or in violation of any applicable laws
Attempt to reverse-engineer, decompile, or extract source code from the App
Use automated tools, bots, or scrapers to access the App or its data
Interfere with or disrupt the App's servers, networks, or infrastructure
Impersonate any person or entity, or falsely represent your affiliation
Upload or transmit any malicious code, viruses, or harmful content
Harvest, collect, or store personal data of other users without consent
Use the App to stalk, harass, or harm any individual
6. User-Generated Content
By submitting crowd reports, check-ins, or notes, you grant PulseMap a non-exclusive, worldwide, royalty-free license to use, display, and distribute that content in aggregated, anonymised form.
You represent that any content you submit is accurate to the best of your knowledge.
We reserve the right to remove any content that violates these Terms or that we find objectionable.
7. Premium Subscription
PulseMap offers a free tier and a Premium tier ($2.99/month or $19.99/year).
Premium subscriptions are processed through the Apple App Store or Google Play Store. Payment terms are governed by those platforms.
Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
Refunds are handled according to Apple App Store and Google Play Store refund policies.
We reserve the right to modify Premium pricing or features with 30 days' notice.
8. Intellectual Property
The App, including its design, code, graphics, and content, is owned by PulseMap and protected by applicable intellectual property laws.
The "PulseMap" name and logo are trademarks of PulseMap. You may not use them without prior written permission.
Nothing in these Terms grants you any right to use our intellectual property except as permitted herein.
9. Third-Party Services
The App uses third-party services including Google Maps, Google Places, Google AdMob, Supabase, Anthropic Claude, and Expo. Your use of these services within the App is also subject to their respective terms and policies. We are not responsible for the practices of these third parties.
10. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT CROWD DATA WILL BE ACCURATE OR COMPLETE. YOUR USE OF THE APP IS AT YOUR SOLE RISK.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PULSEMAP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP. OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.
12. Indemnification
You agree to indemnify and hold PulseMap and its officers, employees, and agents harmless from any claims, damages, or expenses (including legal fees) arising from your violation of these Terms or your use of the App.
13. Termination
We may suspend or terminate your access to the App at any time, with or without notice, for any violation of these Terms.
You may stop using the App and delete your account at any time via Settings → Delete Account.
Upon termination, your right to use the App ceases immediately.
14. Governing Law
These Terms are governed by the laws of the State of North Carolina, USA, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Mecklenburg County, North Carolina.
15. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes through the App or by email at least 14 days before they take effect. Continued use after changes constitutes acceptance.
